Terms of Use

These Terms of Use form a binding agreement between you and Image and Blend ("Amorify", "we", "us"), operator of the Amorify mobile application (the "App"). By creating an account or using the App, you accept these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility and your account

You must be at least 18 years old. We ask for your date of birth during sign-up and refuse anyone under 18. Your date of birth cannot be changed after sign-up. By using the App, you also confirm that:

• you are legally able to enter into this agreement;
• you are not prohibited from using the App under the laws of Canada or any other applicable jurisdiction;
• you have not been convicted of a violent or sexual offence and are not required to register as a sex offender;
• you have not had a previous Amorify account removed by us.

Signing in. You can sign in with Apple, with Google, or with an email address and password confirmed by a verification code. When you use Apple or Google, we receive only what that provider shares to identify you (such as your name and email address). We never post anything on your behalf and never access your contacts.

One person, one account. Your profile must describe you, use photos of you, and stay accurate. You are responsible for keeping your sign-in credentials secure and for all activity on your account. Tell us right away at [CONTACT EMAIL] if you think your account has been compromised.

Changes to these Terms. We may update these Terms as the App evolves. If a change is material, we will notify you in the App at least 30 days before it takes effect. If you keep using the App after that date, the new Terms apply; if you do not agree, you can delete your account at any time.

2. How Amorify works

Amorify helps adults meet people nearby. Your profile is shown to other members based on location, age, gender preferences and the filters each person sets.

• Discover. Swipe right (or tap the check) to like a profile, left (or tap the X) to pass.
• Matches. When two people like each other, a match is created and a private chat opens. Either person can unmatch at any time, which ends the chat.
• Message requests. A Premium member can send a message with a like before any match. It appears in your Message requests. You can accept it (which creates a match and opens the chat) or delete it; the sender is not told that you deleted it.
• Online status. Other members can see when you were recently active, rounded to 5-minute steps. You can hide this in Settings; if you do, you also will not see other members' status.
• Location and distance. We show other members your approximate distance in whole kilometres, never your exact position.

Free use. The App is free to use, with a limited number of swipes that refill over time. Free accounts see occasional ads, labelled "Sponsored", among profiles. Free members can see that someone liked them, but not who.

Premium (paid subscription) adds unlimited swipes, Super Likes, a clear view of who liked you, no ads, and messages before a match. Features, limits and prices may change; we will show any change in the App before it applies to you.

We do not guarantee any number of matches, messages or dates, or that any member will meet your expectations.

3. Premium subscriptions

Premium is sold only through Apple's App Store and billed to your Apple ID. Current plans, in Canadian dollars, taxes extra where applicable:

• Automatic renewal. Your subscription renews automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Apple charges your account within 24 hours before renewal.
• Cancelling. Manage or cancel at any time in your iPhone's Settings → [your name] → Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you paid for.
• Deleting your account does not cancel your subscription. Cancel it with Apple first.
• Refunds. Payments are processed by Apple, so refund requests go to Apple at reportaproblem.apple.com. This does not limit any right you have under consumer protection law, including Quebec's Consumer Protection Act.
• Price changes. If we change a price, Apple will notify you, and ask for your consent where required, before the new price applies.
• Restoring purchases. Use "Restore purchases" on the Premium screen if you reinstall the App or change devices.

Swipes, Super Likes and other in-app allowances have no cash value and cannot be transferred or exchanged.

4. Community rules, safety and moderation

You agree not to:

• create a fake profile, impersonate anyone, or use photos that are not of you;
• post or send nudity, sexual content involving anyone, or any content involving a minor;
• harass, threaten, bully, stalk or intimidate anyone, or post hateful or discriminatory content;
• scam other members, ask for money or financial details, or promote products, services or other platforms;
• share another person's private information without their consent;
• use the App for commercial purposes, or use bots, scrapers or automated means to access it;
• try to bypass limits, security measures or paid features, or interfere with the App's operation.

Your content. You keep ownership of the photos, text and messages you share ("Your Content"). You give us a non-exclusive, royalty-free, worldwide licence to host, store, resize, display and transmit Your Content only to operate and improve the App. This licence ends when you delete the content or your account, except for content we must keep for safety or legal reasons (see the Privacy Policy). You confirm you have the right to share Your Content.

Blocking and reporting. You can block or report any member from their profile or chat. Blocking ends any match and hides each of you from the other. Reporting someone also blocks them automatically.

Moderation. Authorised Amorify staff may review reported profiles, photos, and messages between the members involved in a report, and may review newly uploaded photos. If you break these Terms, we may remove content, suspend your account for a set period (for example 7 or 30 days) or close it permanently, with or without prior notice. A suspended account is hidden from other members.

Your safety. We do not conduct criminal background checks or verify members' identities. Use caution when talking to or meeting anyone: meet in public places, tell a friend where you are going, and never send money. You are solely responsible for your interactions with other members. If you believe someone is in danger, contact local emergency services (911 in Canada).

5. Legal terms

Ending your account. You can delete your account at any time in Settings → Delete account. We may suspend or close your account as described in section 4. Sections 4 (Your content licence for retained content), 5 and any accrued rights survive termination.

Disclaimer. The App is provided "as is" and "as available". To the extent permitted by law, we make no warranty that the App will be uninterrupted, error-free or secure, or about the conduct of any member.

Limitation of liability. To the extent permitted by law, Amorify is not liable for indirect, incidental, special or consequential damages, or for the conduct of any member on or off the App. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or 100 CAD if you paid nothing. Nothing in these Terms excludes liability that cannot be excluded by law, including under the Civil Code of Québec and Quebec's Consumer Protection Act.

Indemnity. You agree to compensate us for claims and losses arising from Your Content or your breach of these Terms, to the extent permitted by law.

Apple App Store terms. These Terms are between you and Amorify, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; Apple has no other warranty obligation. Apple is not responsible for any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a Canadian or U.S. government embargo and are not on any government list of prohibited or restricted parties.

Governing law. These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Disputes go to the courts of the judicial district of Montréal, unless the law of your place of residence gives you the right to sue where you live.

Language. These Terms are available in French and English. Les parties ont exigé que le présent contrat soit rédigé en français et en anglais.
